Damage to car or self due to road problems?

A reader writes in with a possible solution to road problem and says 'claim from the council'.    We advise talking a photograph of the problem and keep it handy for your claim.   Remember that there are firms who will pursue your case on a 'no win - no fee' basis.

Rather than spend time and huge sums of money defending a claim, you will find the council will be prepared to settle out of court - because it is more cost effective for them to do so.

If more people did this the highways department would be keen to resolve problems quickly and prevent the claims being presented to the council.

Also remember that council officials must reply to your communication within a certain time - if you get no response or satisfaction then tell your councillor.

Perhaps some reader in the legal profession who feels strongly about this issue may be kind enough to offer further advice - or draft a standard letter of complaint that we can store on one of our pages?    Anyone offering this service will benefit in the long run - we feel sure about that.
