Want To Do A Right To Manage? Don't Die!

So, like so many other developments you want to carry out a Right To Manage, to rid yourself of Peverel /Firstport?

About Peverel suggest it would be helpful to your quest if you don't die during the process!

Residents at Pegasus Court(one of many with the same name managed by Firstport) decided that they had, had more than enough of Peverel/Firstport's overcharging and poor standard of work, so they resolved to carry out a Right To Manage.

They formed a Right To Manage Company and duly served the proper notices.

Unfortunately, during the process of serving the notices, 5 residents died.

Fairhold (the freeholder) and Firstport (the managing agent) immediately siezed upon this in order to thwart the Right To Manage.

They argued that the notices could not have been properly served as the intended recipient was dead.

Fortunately, a tribunal were not persuaded by Firstport's contention that the Right To Manage should be denied for this reason. The tribunal concluded that serving a notice to the address was sufficient to act as a notice as even if the resident had died, their representative would have had access to the notice.

The Pegasus Court residents were granted their Right To Manage, but it does serve to show just how far Firstport will go to forcibly keep developments under their grasping control?
