Peverel have suffered a heavy defeat in court, that will have huge implications for Peverel and may be a major boost for those who live in a freehold property with land maintained and insured by Peverel.
Peverel were chasing a group of freeholders for payment who had disputed Peverel's right to charge them.
Unfortunately for Peverel when asked by the Judge they could not supply any evidence of legal title to the land they had claimed to own.
At this point the Judge found against Peverel and awarded the leaseholders their costs.
It is very probable that this situation is not a "one off". Any resident with a freehold property, where the adjacent land is maintained by Peverel should seek proof of legal title. This is of especial importance if the property was a Bellway new build.
