Tip Top Hats Terms and Conditions


Please read these terms and conditions carefully before completing and returning our booking form.

Once a completed booking form has been accepted in writing by Tip Top Hats, the person named on the booking form will have entered a binding contract on the basis of these terms and conditions. If you have any questions about them please do not hesitate to contact us first.

1. Definitions
‘The client’ means the person or persons named on the booking form. ‘Event’ means the event for which the hats are hired.  ‘Booking form’ means one of Tip Top Hats’ booking forms.

2. Agreement
Agreement on the basis of these terms and conditions arises upon the fulfilment of the following:
a) Receipt by Tip Top Hats of a properly completed booking form accompanied by the payment or deposit specified by that booking form.

b) Clearance of the payment or deposit into Tip Top Hats’ bank account.

c) Acceptance by Tip Top Hats in writing.

d) Tip Top Hats reserves the right, in its absolute discretion and without the need to give reasons, to refuse to accept a booking.  In such circumstances no agreement arises and Tip Top Hats will return any payment accompanying the booking from.

e) The agreement is between Tip Top Hats and the client and is the sole agreement between those parties. No variation of these terms and conditions shall be applicable unless agreed in writing by Tip Top Hats before the relevant event.

f) The person’s name on the booking form shall be deemed ‘The client’ and will be held responsible for signing for, and taking delivery of the agreed number of vintage top hats and returning them to Tip Top Hats after the event in the same condition as they were received.

g) The agreement is governed by English law.

 

3.   Prices and Payment

a)   The prices for top hat hire are laid out in the booking form. Once the form is completed and received by Tip Top Hats, prices are non-negotiable.

b)   Payment must be made, in full prior to the event date and accompanied by a booking form.

c)  Credit or debit card details will be taken as a form of guarantee against any loss or damage to the top hats provided for the event.  (See below: Point 5. e.)


4. Cancellation by client
If the booking is cancelled by the client (for any reason) the following cancellation charge will arise:

a)   Cancellation less than 8 weeks before the event will result in 50% of the full payment being charged.

b)  If a replacement booking can be found by Tip Top Hats, the 50%charge will be reduced to a 10% administration fee.  

The client acknowledges that it is reasonable for such penalties to arise given that Tip Top Hats may not be able to take another booking for the same date at short notice.

5. The Condition and conduct of care of Vintage Silk Top Hats.
a)  The client acknowledges that Vintage Silk Top Hats need a reasonable level of care to retain their condition.  During the Event he/she is required to instruct those people who will be wearing/using the hats, that a high standard of conduct is expected in order to care for the vintage silk top hats hired from Tip Top Hats.

b)  The hats will arrive in good condition in a vintage case designed to protect them during carriage to and from the event.

c)  A velvet ‘mouse’ will be included to maintain the appearance of the knap of the silk top hats.  Simply wipe the hat gently with the ‘mouse’ in the direction of the nap of the silk.

d)  The hats provided for the event are of a good size for gents’ heads, however, due to the stiff nature of the crown of top hats, a good fit of hats to heads cannot be guaranteed.  The client acknowledges that Tip Top Hats cannot be held responsible for poorly fitting top hats at the event.

e) Photographs are taken of each hat before the event, in order that their condition can be assessed accurately on their return.  If there is damage to any hat a charge will be made to the client to cover the refurbishment or replacement of that hat.   The client acknowledges that the replacement value of each hat would be between £1,000 and £1,500.

6. Liability
The client acknowledges that loss, damage and expense incurred to the top hats during The event, from their arrival to their collection for return (by the carriage company), however arising is not the responsibility of Tip Top Hats and that Tip Top Hats’ liability is limited accordingly.

7. Insurance
The client is strongly advised to take out insurance of the type available to cover the risks ordinarily covered by such events.

8. Complaints
In the unlikely event that a client has cause for complaint about the vintage silk top hats provided for the event, the complaint should be made to a representative of Tip Top Hats as soon as possible before The event in order that corrective action can, if necessary, be taken. The client acknowledges that is unreasonable to take no action during an event but to complain later.
However, should a problem not be resolved, complaint should be made in writing within 28 days of the event. To the extent permitted in law Tip Top Hats will not be liable in respect of claims first intimated later than 28 days from the close of the event.
