Terms and Conditions

The supplier is Steven Gibson Ltd trading as www.midgebusters.co.uk, based at 96 Argyll Street, Dunoon, Argyll, United Kingdom, PA23 7NE. Any complaints by the customer in respect of any transaction with the suppliers should be addressed hereto.

Payment Options:

Steven Gibson Limited trading as www.midgebusters.co.uk and hereafter referred to as www.midgebusters.co.uk accepts VISA, MasterCard, Visa Debit, Switch and Bankers Cheques. We are now able to accept your credit card details by e-mail over the Internet using a secure payment system, or you can place your order over the phone (tel: 01369-702147), by fax (01369-706627), or forward a cheque for the full amount. If you wish, we can contact you by telephone to collect your credit card details.

Privacy Policy:

www.midgebusters.co.uk operates a privacy policy in respect of customer's and prospective customer's personal details.
Information required for completion of a transaction is:
Customer full name, address and postcode
Contact phone number(s) and e-mail address
Delivery address (if different)
Details concerning payment i.e. credit card, cheque.

Guarantees:

All manufacturers normal guarantees apply.

Supply of Goods:

It may be, that due to circumstances beyond our control, www.midgebusters.co.uk are not able to guarantee the supply of goods. The acknowledgment generated to a customer at the time an order is placed is confirmation only of the details given by the customer and is not an acceptance of the order. Prices may change at any time or goods may not currently be available. Should this be the case www.midgebusters.co.uk will contact the customer by e-mail, fax or telephone within 5 working days to appraise them of the situation.

Order Acknowledgement:

An order placed on the website will be construed as an offer to purchase from the customer to the supplier and will be acknowledged as received through an order acknowledgement sent to your e-mail address. Acceptance of payment by the supplier constitutes acceptance of the order by the supplier. If there are any problems with your order then you will be contacted directly. The price of the goods shown by the supplier will only remain valid until such times as it is periodically reviewed by the supplier in its own unlimited discretion, bad faith only excepted, or until payment has been received from the customer, or whichever is earlier.

Quality of Goods/Fitness for Purpose:

www.midgebusters.co.uk makes every effort to ensure that products advertised on the site are of a high quality. In the event that goods received are found not to be of satisfactory quality or fit for the purpose described by the manufacturers they may be returned and a replacement (if requested and available) will be sent otherwise we will refund your monies in full. All the details, dimensions and usage of the products shown on the web site have been supplied to www.midgebusters.co.uk by the manufacturers/suppliers. Please note that weights are approximate and may vary according to the packaging used.

Returns Procedures and refunds:

The terms of the Consumer Protection (Distance Selling) Regulations 2000 apply and a customer is thereby entitled to cancel goods ordered and/or arrange return of the goods delivered up to and within 7 days after receipt of said goods.

This does not include goods that have been specifically made or altered to suit the customer’s own requirements.

Notice of cancellation must be given in writing within said period of 7 days. www.midgebusters.co.uk will accept this notice by fax or e-mail. A telephone message does not qualify as a proper notice.

In the event of cancellation by the customer, the customer would require to return the goods to the supplier.

It is the customer's own responsibility to ensure the goods safe keeping and retention of quality and if goods are returned that are not either faulty or wrongly despatched but simply returned as not required, then it is the customer's responsibility to arrange this at the customer's own expense.

Where goods become faulty within the manufacturer's period of guarantee, and the fault is not due to mishandling by the user, action will be taken to repair or replace the item in accordance with that manufacturers warranty.
It is the customer's responsibility to arrange the return of faulty goods at the customer's own expense.

Goods to be returned after the 7 day period above or those that are not faulty, can only be done so with the agreement of www.midgebusters.co.uk who reserve the right, in all cases, to make a re-stocking charge of 30% + VAT. This in no way affects your statutory rights

Delivery Times:

www.midgebusters.co.uk offers delivery within 5 working days on all Stock items using two forms of courier for UK addresses after payment has been received. Personal cheques may take upto 5 working days to clear while credit or debit card payments take less than 24 hours. In the event of goods ordered by the customer not being available within 5 working days from payment, the supplier will advise the customer of such unavailability within that said period and will reimburse any sums paid by the customer unless the customer and supplier agree otherwise by communications by fax or e-mail.

Standard 1st Class Recorded Delivery via the Royal Mail is used for items that weigh under 2KG when packed.

Next day courier will be used for items over 2KG.

All orders received before 2pm GMT between Monday and Friday (excluding Bank Holidays) where the item is in stock will be despatched either by 1st Class Recorded Delivery or by Next Day Courier service after payment has been confirmed. Occasionally the suppliers carriers may, due to circumstances beyond their control, fail to honour the delivery requirements placed upon them and as such www.midgebusters.co.uk can accept no liability for any problem or inconvenience this may cause. Destinations where next day delivery does not apply include; Isle Of Man, Northern Ireland, Channel Islands, Scottish Highlands & Islands, Isle Of Wight , Scilly Isles and the Republic of Ireland.

VAT:

All our store prices are VAT inclusive. A VAT invoice will be forwarded to you with your delivery. When you enter the cashier section of the site you will be presented with an order confirmation that breaks down the gross amount into separate net and vat amounts. This is for the benefit of our VAT registered business clients to facilitate VAT claims.

Delivery Methods & Charges:

All UK Destinations.

At present, www.midgebusters.co.uk does not charge for packing and postage is minimal but www.midgebusters.co.uk does not, at present, offer World Wide delivery.

Republic of Ireland:

We will, on behalf of a customer, arrange delivery to any address in the Republic of Ireland at an additional cost to the customer. Current costs are shown on our website under “Delivery to Ireland”.

We can additionally offer an uplift and return warranty service for an additional fee.

Loss or damage:

If goods are found to have been damaged in transit then they may be returned and a replacement, if requested and if available, will be despatched. If no replacement is available then monies will be refunded in full by www.midgebusters.co.uk must be informed within 7 days of receipt by either e-mail or by telephone on 01369-702147 with confirmation in writing thereafter. It is in your own interests to check the delivery immediately and notify www.midgebusters.co.uk of any problems.

Data Protection Act:

The information requested on this site may be used by www.midgebusters.co.uk to confirm, update and enhance our customer records. Information may also be disclosed and used for fraud detection purposes. In terms of the Data Protection Act you are entitled to a copy of all your personal data held by us on computer on payment of a small fee.

Title:

Title of goods does not pass to the purchaser until the goods are paid for in full. The responsibility and risk in the Goods shall pass to the buyer at the point of delivery and www.midgebusters.co.uk shall have no responsibility in respect of the safety of the goods thereafter.

Security of Credit Card Payment Options:

If you wish to pay by debit or credit card, simply state this when you place an order. We are able to accept payment by credit card using our secure e-mail facility

Law:

All contracts by www.midgebusters.co.uk for the sale of the goods shall be deemed in all respects to be contracts made, performed and contracted according to Scottish Law.
