Terms and Conditions
Pricing
All prices quoted are in Euro and Sterling are subject to verification by a ACE Golf representative. Our quoted prices are based on pre-approved accommodations and are subject to availability. Alternative accommodations may incur an additional cost. Availability of selected golf courses is not guaranteed until tee times are confirmed and conveyed to you. Upgrades, single room supplements etc. are quoted upon request.
Payment terms
A non-refundable booking deposit of 25%pp applies at time of booking to secure and confirm your reservation. Full balance of payment is then required 60 days prior to commencement of holiday or on the date of booking if the booking is made less than 60 days prior to holiday commencement. If it is not paid by that date ACE Golf shall have the option to cancel the holiday after communicating with the customer and cancellation will be subject to a cancellation fee set out below. Payment can be made by Cheque, Wire transfer, Bank Draft, Paypal or Credit Card (Access, Visa & MasterCard).
Cancellations
Notification of cancellation must be forwarded in writing via written/email notification to ACE Golf and is subject to the following per person cancellation charges:
· Up to 6 weeks before arrival – the amount of the deposit
· Within 6-3 weeks of arrival – 30% of the holiday cost & the deposit
· Within 3 weeks or less of arrival – 100% of the holiday cost
Reminder notices will be sent when the balance of your tour is payable, however, we may deem cancelled any tour not fully paid six weeks before the start date of the tour. If you withdraw from a tour before completion, ACE Golf will not be liable for any refunds or for any expenses incurred.
Where one or more of your party cancels the above policy applies pro-rata except in cases where the amended itinerary requires the application of single supplements.
If a supplier cancels a booking we will arrange a suitable alternative or refund any monies you have paid in full. We will not be responsible for related expenses such as non-refundable flight expenses or other arrangements outside of the tour programme.
We strongly recommend the purchase of travel insurance that includes cancellation cover.
Changes
An administrative fee of €25 per change, per person, applies for any changes requested by a client after deposit has been received and confirmation issued. Changes may not be made less than 45 days before travel, except with the approval of ACE Golf.
Unused Portions
In no case will refunds be made for unused portions of booked itineraries.
Car Hire
Rental Cars are considered to be manual drive unless specified. When a specific car is requested, ACE Golf will endevour to provide this car, however a similar car may be given instead depending on availability. Car Driver must be 23 years of age and have a valid driver's license. Car Hire, includes, unlimited mileage, CDW (collision damage waiver) and valued added tax. Price does not include petrol/gas, additional driver fee, excess insurance, or any fines. At the car hire desk you will be offered the opportunity to buy extra insurance to cover this excess.
Travel Insurance
We strongly advise that the consumer has adequate travel insurance scheme that conforms to EU legislation in respect of package holidays. Customers can - due to unforeseen circumstances be forced to cancel prior to or during their holiday. All claims made against the insurance policy will be made directly to the insurer. The Consumer shall be responsible for making any special or increased insurance arrangements that he deems necessary. ACE Golf will accept no liability for clients not having travel insurance of their own.
Consumer Responsibilities.
· To check all travel documentation furnished to him/her.
· To inform him/herself of passport and visa requirements (see general information section) and ensure where necessary their validity.
· To check with the port authorities/carriers from where you are to depart whether there are likely to be any delays or other problems with flights or ferry crossings before you depart.
· To present him/herself at the port of departure in sufficient time prior to the designated departure time to complete embarkment requirements.
· The consumer is restricted by regulation of carriers and executive authority with regard to weight, type and contents of baggage etc.
Power of Attorney
As a client of ACE Golf, you hereby appoint employees of ACE Golf to be your attorneys-in-fact for the purpose of signing all documents necessary to purchase hotel and green fee reservations and any other services requested by you and supplied, and to charge these purchases to the credit card on your booking form. You agree to pay for all such purchases and will not hold ACE Golf responsible for any of its actions pursuant to this power of attorney.
Alterations by ACE Golf
If as a result of force majeure (that is any event which ACE Golf or any supplier of services could not foresee or avoid such as closure of golf courses or accommodations because of weather or course condition, war or threat of war, industrial dispute, natural or nuclear disaster, fire, adverse weather conditions and other similar events outside our control or that of our suppliers) or if ACE Golf is forced to alter, amend, change the holiday, the consumer cannot maintain a claim for compensation. ACE Golf undertakes that in the event of having to alter accommodation, golf course or transportation it will provide a level of service comparable or better at no extra cost. The consumer should be aware that some suppliers i.e. hotels and golf clubs impose cancellation fees/restrictions etc., which are outside the control of, and for which, ACE Golf will not be held liable.
Complaints procedure
ACE Golf Tour’s policy is to react in a positive and courteous manner and to endeavour to resolve to your satisfaction any complaints you may have. We welcome any feedback, positive or otherwise, as we use this information to improve our service to you and all our customers. In the event that you have any reason to complain about your holiday, please notify our representative and the supplier of the service in question so that we can resolve the problem quickly. If you have a complaint after your holiday it must be notified in writing to Golf Vacations Ireland within 21 days of the end of your holiday. No liability will be accepted by ACE Golf or its suppliers if written notice is not received within 21 days.
Arbitration
Any dispute or difference, of any kind whatsoever which arises or occurs, between any of the parties hereto, in relation to anything or matter hereunder or arising out of or in connection with this contract, shall be referred to arbitration under the Arbitration Rules of The Chartered Institute of Arbitrators-Irish Branch.
Disclaimer
ACE Golf or any of its agents or employees, shall not be held liable for; and by accepting these terms the customer waives any claim against all such parties for;
(a) any loss of or damage to property or injury to any person caused by reason of any defect, negligence, or other wrongful act or omission of, or any failure of performance of any kind by; any other transportation company; vendor or supplier;
(b) any inconvenience, loss of enjoyment, mental distress or other similar matter;
(c) any delayed departure, missed connections, substitutions of accommodations, terminations of service, or change in fares or rates; and
(d) any cancellation or double booking of reservations or tickets beyond the control of ACE Golf.
ACE Golf does not accept responsibility for losses or additional expenses due to delays or changes, quarantine, sickness, strikes, war, weather, acts of God or other causes. Such losses or expenses will have to be borne by the customer. Cancellation insurance is highly recommended.
On advancement of the tour deposit to ACE Golf, the depositor (and all participants for whom the deposit is paid) therefore agree to be bound by the above recited terms and conditions.
